Terms of Service

By accessing or using Munchi ("Munchi," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Munchi is a mobile application and related service that may provide:

• Calorie and nutrition tracking
• Food logging and meal history
• AI-powered meal analysis from photos or text
• Progress tracking for goals, weight, and water
• Optional Apple Health integrations
• Paid subscriptions and limited promotional or founder offers

We may modify, suspend, or discontinue any part of the Service at any time.

To use certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account and credentials
• Be responsible for activity that occurs under your account
• Notify us of unauthorized access or suspected misuse

You must be at least 14 years old to use Munchi.

You agree not to:

• Use the Service in violation of law or regulation
• Upload harmful, unlawful, deceptive, or infringing content
• Interfere with the Service, its security, or its availability
• Use bots, scrapers, or other automated means to abuse the Service
• Attempt to gain unauthorized access to systems or accounts
• Collect or harvest information about other users without consent
• Use the Service for unauthorized commercial purposes

You retain ownership of content you submit to Munchi, including meal photos, food entries, and notes. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, analyze, and process that content as necessary to operate, maintain, secure, and improve the Service.

You represent that you have the rights needed to submit your content and that it does not violate the rights of others.

Munchi is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment.

You should:

• Consult a qualified healthcare professional before making significant dietary or health changes
• Not rely solely on Munchi for medical or nutritional decisions
• Understand that calorie counts, nutrition estimates, AI outputs, and recommendations may be incomplete or inaccurate

The Service and its original content, branding, features, and functionality, excluding user content, are owned by Munchi or its licensors and are protected by applicable intellectual property laws.

You may not:

• Copy, modify, distribute, or exploit our content without permission
• Use our name, branding, or marks without written consent
• Reverse engineer or attempt to extract source code except where prohibited by law

Your use of the Service is also governed by our Privacy Policy. By using Munchi, you consent to the collection and use of information as described there.

Some features of Munchi may require a paid subscription or paid offer. If you purchase access:

• You authorize the applicable app store or payment platform to charge your selected payment method
• Auto-renewing subscriptions renew automatically unless cancelled before renewal
• You can manage or cancel store subscriptions through the App Store or Google Play account used for purchase
• Deleting the app or deleting your account does not by itself cancel a subscription
• Pricing, billing periods, free trials, and included features are shown at the time of purchase

Refunds for App Store and Google Play purchases are processed by Apple or Google according to their respective policies, not by Munchi directly. To assist Apple in evaluating refund requests, we may share consumption data with Apple, including the number of times you have used core features (such as snaps taken), account age, subscription history, and similar usage signals. Apple uses this data to help determine refund eligibility. By accepting these Terms, you consent to this sharing of consumption data with Apple for the purpose of refund processing.

Munchi may rely on or integrate with third-party services, including authentication providers, cloud infrastructure, analytics providers, AI processing providers, app stores, subscription platforms, and Apple Health. Those services may be governed by their own terms and privacy policies.

If you access Munchi through the Apple App Store, your use of the iOS app is also subject to Apple's applicable Usage Rules and the Apple Standard EULA unless a separate custom EULA is expressly provided. Nothing in these Terms limits any non-waivable rights you may have under applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, error-free, or fully accurate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUNCHI AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

We may suspend or terminate your access to the Service if we reasonably believe you violated these Terms, misused the Service, created risk for us or others, or where continued operation is no longer practical. You may stop using Munchi at any time and may delete your account through available account settings.

We may modify these Terms from time to time. If we make material changes, we may post the updated Terms, update the effective date, and provide additional notice where appropriate. Continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms.

These Terms, together with our Privacy Policy, form the entire agreement between you and Munchi regarding your use of the Service.
